BirdyFoot Terms of Service

1. Acceptance of Terms: By accessing or using BirdyFoot's credit card processing services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Services: BirdyFoot provides credit card processing services for merchants, enabling them to accept credit and debit card payments from their customers.

3. Merchant Account: Account Creation: To use our services, you must create a merchant account. You agree to provide accurate and complete information during the registration process.
Account Security: You are responsible for maintaining the confidentiality of your account credentials. Any activities that occur under your account are your responsibility.

4. Fees and Payments: Processing Fees: The Fees are stated on the BirdyFoot Pricing Page, unless you and BirdyFoot otherwise agree in writing. BirdyFoot may revise the Fees at any time. If BirdyFoot revises the Fees for a Service that you are currently using, BirdyFoot will notify you at least 30 days before the revised Fees apply to you.
Payment Schedule: Funds from processed transactions will be deposited into your designated bank account within 5 business days, minus our processing fees.

5. Prohibited Activities: You agree not to use our services for any illegal or unauthorized purpose, including but not limited to:
- Money laundering
- Fraudulent transactions
- Sale of illegal goods or services
We reserve the right to terminate your account if we suspect any prohibited activities.

6. Data Security and Privacy: We comply with PCI DSS (Payment Card Industry Data Security Standard) requirements to ensure the security of cardholder data. Our privacy policy outlines how we collect, use, and protect your information.

7. Chargebacks and Disputes: You are responsible for all chargebacks, refunds, and disputes related to transactions processed through our system. We may withhold funds to cover potential chargebacks.

8. Termination: We reserve the right to suspend or terminate your account at any time for any reason, including violation of these terms. You may also terminate your account by providing written notice.

9. Limitation of Liability: Our liability is limited to the amount of fees paid by you for our services in the month preceding any claim.

10. Changes to Terms: We may modify these terms at any time. Continued use of our services after such changes constitutes acceptance of the new terms.
